Terms of Service

1. General Provisions

These Terms of Service (the "Terms") govern access to and use of the Stable Nude service (the "Service"). The Service is operated by the operator of the Stable Nude project (the "Operator").

By using the Service, the User confirms they have read, understood and accept these Terms in full. If the User disagrees with any clause, they must immediately stop using the Service. Acceptance of these Terms constitutes the conclusion of an electronic contract (an offer agreement).

2. Definitions

  • "Service" — the Stable Nude software-and-infrastructure platform available at stablenude.ai and via the official Stable Nude Telegram bot.
  • "User" — a natural person using the Service.
  • "Account" — the User's registered profile in the Service.
  • "Materials" — any files, images, videos, text and other data uploaded by the User to the Service.
  • "Results" — media files generated by the AI tools of the Service at the User's request.
  • "Credits" — the internal accounting unit of the Service used to access paid features.
  • "Tools" — the AI features of the Service (face-swap, generate-photo, animate-photo and others).
  • "Complaint Channel" — the in-Service feedback form on the website and the official Telegram bot of the Service. This is the sole channel of legally significant communication recognised by the Operator.

3. Eligibility

Use of the Service is permitted only to persons aged 18 or older. On registration and on first use of age-restricted Tools, the User confirms they are of legal age. The Operator reserves the right to suspend the Account on reasonable suspicion of underage use and to disclose held data to law-enforcement authorities in accordance with applicable law.

Access to the Service is restricted in jurisdictions where AI-generated adult content is prohibited. Circumventing geo-restrictions (VPN, proxy or other means) from such jurisdictions constitutes a material breach of these Terms.

The User warrants they do not appear on the OFAC SDN list, the consolidated sanctions lists of the EU, the UK (OFSI), or the UN.

The User bears full responsibility for any activity carried out through their Account, including activity of third parties to whom the User granted access.

4. User Content Warranties

By uploading Materials, the User warrants that they hold all necessary rights and documented consent of every person depicted in the Materials to upload, process and generate Results based on those Materials.

The User warrants that uploaded Materials do not contain depictions of minors in any context.

The User bears sole criminal, civil and administrative liability for their Materials and Results, including their subsequent use, storage and distribution outside the Service.

5. Prohibited Use

The Service may not be used to:

  • produce content involving minors (CSAM) — zero tolerance;
  • produce non-consensual intimate imagery (NCII) — zero tolerance;
  • produce deepfake content without documented consent of the depicted person;
  • infringe third-party intellectual-property rights;
  • commit fraud, phishing or impersonation;
  • distribute malware or exploits;
  • perform automated scraping, bypass rate limits or run model-extraction attacks;
  • resell the Service's functionality as a service (Generation-as-a-Service);
  • conduct any activity that violates applicable law.

The full list of prohibited use is set out in the Acceptable Use Policy, which forms an integral part of these Terms by reference.

If CSAM, NCII or another grave violation is detected, the Operator immediately suspends the Account, preserves the related data for potential law-enforcement requests and notifies competent authorities as required by applicable law.

6. Credits and Payment

Credits are the internal accounting unit of the Service. Credits are not currency, e-money or securities, are not redeemable for cash and cannot be transferred to another Account.

Credit purchases and refund conditions are governed by the Refund Policy.

Technical failures that prevent a paid request from delivering a Result are compensated by automatic return of spent Credits to the Account balance.

A chargeback (payment reversal via the User's bank or payment provider) initiated bypassing the Refund Policy and the Complaint Channel constitutes a material breach of these Terms. Consequences: immediate Account suspension, forfeiture of unused Credits and suspension of any previously paid features.

7. Results: License and Ownership

Uploaded Materials remain the User's property. The Operator receives a limited right to store, process and transmit Materials to the AI models used by the Service, solely for the purpose of providing the Service to the User.

Subject to payment of the relevant Credits, the User receives, in respect of their Results, a non-exclusive, worldwide, perpetual licence for personal and commercial use, restricted by:

  • the prohibitions set out in these Terms and the Acceptable Use Policy;
  • a prohibition on reselling Results as a Generation-as-a-Service product;
  • a prohibition on attributing Results to a real person without that person's documented consent.

The Operator retains a non-exclusive right to host, cache and display Results to the User as part of operating the Service, and to collect and use anonymised technical telemetry.

The Operator does not use User Materials or Results to train, fine-tune or otherwise condition AI models, and does not transfer them to third parties for model-training purposes.

8. Service Availability

The Service is provided on a best-effort basis without warranties of availability, uninterrupted operation, accuracy or fitness for a particular purpose.

Individual Tools may be marked in the interface as beta or experimental. The Operator does not warrant the quality, speed or availability of such Tools.

Scheduled maintenance, outages at GPU-capacity providers, force-majeure events, hardware failures and other technical causes do not constitute a breach of these Terms.

9. Operator Intellectual Property

All elements of the Service (source code, design, graphics, logos, text, brand assets, documentation) are intellectual property of the Operator and/or its licensors and are protected by copyright and related-rights law.

The following are prohibited:

  • copying, distributing or republishing any element of the Service without the Operator's written permission;
  • automated data collection (scraping), parsing or indexing of the Service by any means other than a standard browser;
  • reverse-engineering, decompilation, attempts to extract AI-model weights or training data (model-extraction attacks);
  • automated bulk generation of requests in excess of the rate limits set by the Operator.

10. Privacy

Processing of Users' personal data is governed by the Privacy Policy, which forms an integral part of these Terms. The use of cookies is governed by the Cookie Policy.

Disclosure of User data to third parties, including law-enforcement authorities, is performed only on lawful grounds and in the manner prescribed by applicable law.

11. Indemnification

The User shall defend the Operator and indemnify it against any claims, suits, fines and costs (including reasonable legal fees) arising from:

  • the User's Materials and Results;
  • the User's breach of these Terms;
  • the User's violation of third-party rights.

The Operator may assume the defence of any such claim at the User's cost; in that case the User shall cooperate with the Operator in good faith.

12. Limitation of Liability

The Service is provided "as is" and "as available" without any express or implied warranties, to the maximum extent permitted by applicable law.

The Operator's aggregate liability for any claim related to the Service is capped at EUR 100 (one hundred euros).

The limits in this clause do not apply to liability for the Operator's wilful misconduct or gross negligence, or to liability that cannot be excluded or limited under applicable law.

13. Violations and Account Termination

The Operator may immediately suspend or terminate access to the Account in any of the following cases:

  • breach of these Terms or the Acceptable Use Policy;
  • indications of fraud or attempts to bypass the Service's security mechanisms;
  • chargeback initiated by the User;
  • the User appearing on a sanctions list;
  • reasonable suspicion of underage use;
  • repeat reports of NCII or other grave violations;
  • abuse through a shared Account.

Consequences of termination:

  • access to the Service ends;
  • unused Credits may be forfeited, except as expressly provided in the Refund Policy;
  • User data is retained in accordance with the Privacy Policy and applicable law.

14. Complaints and Takedown

All legally significant notices, claims, takedown demands, data-subject rights requests and other communications shall be submitted by the User solely through the Complaint Channel — the in-Service feedback form on the website and/or the official Telegram bot of the Service. The Operator does not use and does not recognise any other communication channels.

Copyright complaints under DMCA must follow the procedure described on the DMCA page.

Reports of non-consensual intimate imagery (NCII) and reports from persons depicted in Materials or Results without their consent are handled on a priority basis. The target response time is 48 hours from receipt via the Complaint Channel.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before going to court, the parties shall undertake a good-faith attempt to resolve the dispute through the Complaint Channel for at least 30 (thirty) calendar days from the date of the first claim.

The User waives participation in class actions against the Operator to the maximum extent permitted by applicable law and confirms that any claim shall be brought solely on an individual basis.

16. Miscellaneous

  • Changes to the Terms. The Operator may amend these Terms. Notice of material changes is published on the Terms page at least 14 (fourteen) calendar days before they take effect. Continued use of the Service after the changes take effect constitutes the User's acceptance of the updated Terms.
  • Electronic Notices. All notices sent by the Operator to the User within the Service (in the user dashboard, through the Service interface or via the official Telegram bot), and the User's communications through the Complaint Channel, are legally binding. Electronic correspondence by any other means does not create obligations for the Operator.
  • Force Majeure. The Operator is not liable for non-performance caused by events beyond its reasonable control (war, sanctions, outages at service providers, cyber-attacks, natural disasters and the like).
  • Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
  • No Waiver. The Operator's failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  • Assignment. The Operator may assign its rights and obligations under these Terms in whole or in part without the User's consent. The User may not assign their rights or obligations without the Operator's written consent.
  • Survival. The provisions on User Content Warranties, Results License, Indemnification, Limitation of Liability, Violations and Termination, and Governing Law and Disputes survive termination of these Terms.
  • Entire Agreement. These Terms, together with the Acceptable Use Policy, Privacy Policy, Refund Policy, DMCA Policy and Cookie Policy, constitute the entire agreement between the User and the Operator regarding the Service and supersede all prior arrangements.
